Podle slov tiskové mluvčí ministerstva spravedlnosti Terezy Palečkové: "Své připomínky k novému občanskému zákoníku, který by měl nahradit ten současný, pocházející z roku 1964, budou moci experti i laici na adresu ministerstva zasílat až do úterý 25. ledna."

Návrh nového občanského zákoníku v současné době obsahuje více než tři tisíce paragrafů a skládá se z pěti částí. Jedná se o návrh schválený vládou již v roce 2009, který byl následně předložen poslanecké sněmovně, ta však návrh v minulém volebním období nestihla projednat.

Návrh nového občanského zákoníka včetně důvodové zprávy je dostupný na portálu justice.cz. Připomínky k návrhu zákona lze podávat na emailovou adresu obcanskyzakonik@msp.justice.cz.

Návrh občanského zákoníku je chápán jako základní kodex soukromého práva, který se v části první věnuje statusovým otázkám – právo osob (ochrana osobnosti, svéprávnost), v části druhé oblasti rodinnému právu, které je v současnosti upraveno v samostatném zákoně. Část třetí upravuje absolutní majetková práva (vlastnictví, spoluvlastnictví, držba, dědické právo). Nejobsáhlejší čtvrtá část se zabývá relativními majetkovými právy (vznik, obsah, zajištění a zánik závazků, jednotlivé smluvní typy). V poslední páté části jsou uvedena ustanovení společná, přechodná a závěrečná, jež upravují především pravidla přechodu ze současné právní úpravy na nový zákoník.

Nový návrh do sebe pojme některé stávající zákony a vytvoří tak komplexní zákon. Nahradit by měl především zákon č. 72/1994 Sb., o vlastnictví bytů, zákon č. 94/1963 Sb., o rodině a dále zákon č. 83/1990 Sb., o sdružování občanů.

Dobrý den, v současné době je možné, aby vlastník stavby nebyl vlastníkem pozemku, na němž se stavba nachází. Vznikají tak nejrůznější komplikace a spory mezi vlastníkem pozemku a stavby na něm umístěné. Nový návrh občanského zákoníku se vrací k zásadě, která u nás platila před rokem 1950, a to té, že součástí pozemku je i stavba. Přesně je tato problematika upravena v ustanovení § 478 odst. 1 návrhu: „Součástí pozemku je prostor nad povrchem i pod povrchem, stavby zřízené na pozemku a jiná zařízení (dále jen "stavba") s výjimkou staveb dočasných, včetně toho, co je zapuštěno v pozemku nebo upevněno ve zdech“. Tam, kde bude ke dni účinnosti nového občanského zákoníku stejný vlastník pozemku i stavby na něm zřízené, stane se stavba součástí pozemku přímo ze zákona. Pozemek i stavba tak budou tvořit jedinou věc v právním smyslu.

Pokud budete vlastníkem pozemku i stavby na něm umístěné, pak při převodu pozemku na jinou osobu bude po účinnosti nového zákona přecházet automaticky s pozemkem i stavba.

Majitelem stavby zůstanete stále Vy, nepřijdete tak o svoji nemovitost. Jedná se pouze o to, že pokud by chtěl majitel pozemku i stavby převést samostatně například pozemek, bude od účinnosti novely nucen převést i stavbu. Do budoucna by se mělo zamezit rozkolu mezi majiteli pozemku a stavby.

Je to opět zakládání na veliký problém, protežování pozemkových vlastníků, už vidím těch soudů, které z tohoto vzejdou. Je z toho vidět jaké skupině vlastníků zákonodárci fandí. Mělo by to být zabezpečeno alespoň tím, ža majitel stavby má přednostní právo na zakoupení pozemku pod stavbou za stanovenou nebo alespoň obvyklou cenu s právem na přístupovou cestu. A i tak je to úžasně zneužitelné - ze strany vlasníků pozemků. Je to systém, jak zajistit určité skupině nezanedbatelné příjmy.

To znamená, že majitel pozemku je povinen nabídnou vám jako prvnímu odkup pozemku. To sam= je to i z druhé strany. Je zde snaha sjednotit majitele staveb a pozemků. Ale určitě to nebude nijak soudně nebo uměle tak, že byste přišli o své nemovitosti.
